Protecting your personal information is very important to Elsewhere B.V., trading under the name Elsewhere Fashion. We want to be open and transparent. We therefore formulated a policy, explaining how your personal information is processed and protected.

Who is the administrator of your personal data?

Elsewhere Fashion is convinced that the protection of the privacy of its customers and visitors is essential for its activities and success. Personal information will be handled secure and with great care. Elsewhere Fashion abides to the requirement of the Personal Data Protection Law. Elsewhere Fashion is responsible for all the data processing and acts in accordance with the Personal Data Protection Law.

What are the legal grounds for using your data and personal information?

We need information from you because of contractual arrangements between you and Elsewhere Fashion. For instance for your processing purchase or for quality guarantee on the ordered products. We need this information for:

Who has access to your data and information?

Your data can be shared within Elsewhere Fashion but we will never forward, sell or exchange your information to/with third parties outside of Elsewhere Fashion for marketing purposes. We will only share data with third parties to provide your with our services.

Where do we store your data?

We store your data in different databases, where we always apply strict security measures. That is why we almost always store data and information within the European Union. In the exceptional case that data is stores in countries outside of the European Union, we ensure that your privacy is protected in an appropriate manner.

Secure SSL

Elsewhere Fashion entire order process is secured with Secure Socket Layer (SSL). This means that as soon as you continue from the shopping cart to the order process, the page will automatically switch to an SSL connection. An SSL connection cannot be ‘tapped’.

A website that is secured with SSL has two characteristics:

  • With SSL security the identity of the website is guaranteed
  • SSL is intended to create a secure connection. This means that the information that goes back and forth between your PC (desktop, tablet or mobile phone) and the website cannot be read or edited by others, because it is encrypted
  • A secure connection can be recognized by the websites address, this should start with https://. There should also be a lock at the bottom of the page, or next to the address bar

In addition to the secure order process, we also make sure all your personal data is sent safely to us and from us. For example, when you contact us by using the contact form on our website.

What data do we keep?

Elsewhere Fashion stores your personal data in a secure database. And that is where the data will stay too. We will not pass your information to third parties for commercial purposes. We just need this information from you to make sure your purchase will go as smoothly as possible. We would like to know your first- and last name, address and place of residence, telephone number, payment details, IP address and e-mail address.

We will also ask for your birth date if your use the payment method Klarna (required) or after confirmation of your order (optional). Your date of birth will be used for sending you a present on your birthday.

How long do we keep your data and personal information?

We do not store and use your data for longer than necessary. Then we delete all data we have from you. Or we use your data anonymously, because we need certain data for internal analyses and reports such as the value of your order.

We keep certain deadlines, after which we delete your data. Such as: – We will not store camera images of our stores for more than 4 weeks. Unless we see something suspicious that we have to further investigate whether the images should be kept longer because of another legal obligation.

  • We delete inactive client accounts after 7 years. After that period we only use your data anonymously, for internal reports.
  • We must keep your invoice, payment information and order data in our administration for 7 years for the tax authorities. After that, we will only use anonymous data for internal reports.
  • If you have subscribed to the newsletter or have given permission to receive personalized messages, we will retain that permission for 5 years. Even if you decide at a certain moment that you no longer wish to receive the newsletter or personalized messages, we will retain the withdrawal of your request. We will not keep the e-mails that you receive from us for more than 60 days. You do not have to worry that you will receive the same mail from us more often. After that period we only use your data anonymously, for internal reports.
  • We retain data that we use to prevent fraud for a long time until a case is resolved.

What are your rights?

Right of access

You have the right to request information about the personal data we keep about you at any time. You can contact Elsewhere Fashion Customer Service who can provide you with this personal data via e-mail.

Right to portability

When Elsewhere Fashion processes your personal data in an automated manner on the basis of your consent or on the basis of an agreement, you have the right to obtain a copy of your data in a structured, generally used and machine-readable format, transferred to you or to a third party. This only applies to the personal data that you have provided to us.

Right to correction

You have the right to request the correction of your personal data when they are incorrect, including the right to complete incomplete personal data. If you have a Elsewhere Fashion account, you can change your personal details in your account.

Right to removal

You have the right to remove personal data processed by Elsewhere Fashion at any time, except in the following situations:

  • You have a current business with customer service
  • You have an outstanding order that has not yet or partially been sent
  • You have a debt not yet settled with Elsewhere Fashion., regardless of the payment method
  • You are suspected of having misused our services in the past four years or you have misused our services in the past four years
  • Your debt has been transferred to a third party in the past three years or in the past year when the customer is deceased
  • If you have made a purchase, we will retain your personal data in connection with your transaction for administration and accounting purposes

The right to object to direct marketing

You have the right to object to direct marketing, including profile analysis for direct marketing purposes. If you no longer wish to receive direct marketing, you can adjust the settings of your Elsewhere Fashion account yourself.

Click behaviour

On the Elsewhere Fashion websites general visitor data are saved and analysed, such as the most visited pages. We do this without identifying these visitors. The purpose of this is to optimize the layout and design of the website. The data may also be used to expand and improve the content on the website as well. This way Elsewhere Fashion can further optimize the website and services for you.

Use of Hotjar

We use the Hotjar tool to improve the user experience. Hotjar allows us to measure and assess user activities (mouse movements, click and scroll behaviour). In this way we can improve our services and the user experience. To guarantee your privacy, we have concluded a processing agreement with Hotjar. If, despite all the measures taken, you still do not want us to monitor your behavior anonymously, there is an opt-out option. What are cookies?
